This policy is being created to establish a consistent framework for the leasing of real property by the University in a manner that complies with governing laws, regulations, and policies, while supporting the University’s mission, promoting the efficient and responsible use of University and state resources, safeguarding the public interest, and protecting the present and future use of University property.

Some of the key provisions of this policy include:

• Requiring that all leases of real property to or from the University be approved by the Office of General Counsel as to form and legal sufficiency prior to execution.
• Requiring that all leases be approved by the President of the University, except as otherwise authorized under the policy.
• Setting forth specific circumstances under which the Senior Vice President, Finance, Administration, and Operations and the Executive Vice President, Research and Industry and Defense Programs may approve leases without the approval of the President of the University.
• Setting forth the requirements for determining lease rates when the University is the lessor.
• Setting forth the requirements for publication of notice of intent to lease when the University is the lessor.
• Setting forth the requirements for oil, gas, and mineral leases.
• Setting parameters for making changes to this policy.
• Providing a process for making lease requests, including entering, amending, renewal, cancellations, and terminations.
• Requiring that all executed lease agreement documents be transmitted to and maintained by the Office of General Counsel.

This policy is being created to establish a consistent framework for the review, approval, acquisition, granting, modification, and administration of easements affecting property owned, leased, or controlled by the University or the State of Kansas as set forth in this policy.

Some of the key provisions of this policy include:

• Setting forth the University’s authority and discretion to grant and convey easements on property that is in the custody or control of the University and belonging to the University or the State of Kansas.
• Requiring that the terms of such easement shall be determined by the University as necessary to protect the interests of the University, the State of Kansas, and the public.
• Limiting University easements to granting only those property rights reasonably necessary to accomplish easement’s stated purpose, unless otherwise approved by the Office of General Counsel, with all other non-expressed rights reserved to the University or the State of Kansas, as applicable.
• Requiring that before granting or conveying an easement the University must determine that the easement appropriately safeguards the public interest and does not unreasonably interfere with or impair the present or reasonably anticipated future use, operation, development, improvement, or disposition of the affected University property.
• Clarifying that the University has the discretion to grant an easement with or without monetary or other consideration, as permitted by law, and to require an appraisal, valuation, or other evidence of fair value as appropriate, necessary, and/or when required by law or policy.
• Setting forth the circumstances under which an easement will terminate automatically and what shall occur upon termination.
• Setting forth the rights and limitations of a grantee to further convey or assign an easement granted by University.
• Limiting the use of an easement to the purpose for which it was granted and requiring approval by the University for any expanded or modified uses.
• Requiring that all easements be recorded in the appropriate county, with copies provided to the Kansas Board of Regents.
• Allowing exceptions to the policy only as permitted by law and Kansas Board of Regents policy, and upon the approval of the Office of General Counsel and the President of the University (or their designees).

This policy is being revised to clarify what is meant by professional license or certification.

Specific changes include:

• Added a definition for professional license or certification.
• Updated language throughout policy to align with definition of professional license or certification.

This policy is being revised to ensure compliance with the University’s requirements for usage of its name, seal, logos, and other University Marks by student organizations. Additional updates were made for purposes of clarification and to conform to the University’s standard policy format.

Specific changes that were made include:

• Clarified that University Marks include both registered and unregistered Marks.
• Added definitions for Recognized Student Organization, Affiliated Student Organization, and Sponsored Student Organization in order to clarify the restrictions on use of University Marks by certain student organizations.
• Clarified that Sponsored Student Organizations may use University Marks in connection with their respective missions and in furthering the interests of the University, in accordance with this policy.
• Added that Affiliated Student Organizations may not use University Marks, except as otherwise set forth in this policy or in the University’s Visual Identity Standards Manual.
• Added that an Affiliated Student Organization that wishes to indicate a connection with the University may use the phrases “at Wichita State University” or “at Wichita State” following the organization or club name.
• Removed definition for non-affiliated organizations because it is not used in the policy.
• Updated applicable laws and resources section to include WSU Student Organization Handbook.
